Following action by Gail and Jason to support residents’ complaints about unauthorised tipping, a Stop Notice and an Enforcement Notice have been served on the owners of the land, along with any interested persons.
The Stop Notice came into effect on 28th February 2021 and will remain in effect until the compliance period specified within the Enforcement Notice expires. The Stop Notice requires the following:
1. Cease the tipping of material and rubble; and
2. Cease all works for the creation of a track.
The Enforcement Notice comes into effect on 2nd April 2021 and has a one month compliance period that expires on 2nd May 2021. The Enforcement Notice requires:
1. Cease the use of the land for tipping and remove all tipped material and rubble, including any hardcore and waste material cleared from the reens with the exception of vegetation from the site in its entirety; and
2. Return the land to its original condition prior to the breach of planning control having occurred.
Non-compliance with either the Stop Notice or the Enforcement Notice constitutes an offence that could be subject to prosecution. Recent discussions with the owners have resulted in the site being made secure to prevent any further tipping or other unauthorised activities occurring. Over and above ongoing monitoring of activity at site, a site visit will be made on or shortly after 3rd May 2021 to check compliance with the Enforcement Notice.
